Agreement

These Terms of Use ("Terms") apply to the ASCII Studio app ("the app") and ASCII Studio Pro, made by Morhover ("we", "us", "our"). By downloading or using the app you agree to these Terms. If you don't agree, please don't use the app.

License (EULA)

The app is licensed to you, not sold. Your license is governed by Apple's Standard Licensed Application End User License Agreement (read it on apple.com), together with these Terms, which add to it. If the two conflict, Apple's Standard EULA applies.

We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as permitted by the App Store's Usage Rules.

Your content

You own the photos, videos and creations you make with the app, including for commercial use.
Only use photos and videos you have the right to use. You're responsible for what you create and share.
Your content stays on your device. We never receive it, so we claim no rights to it.

ASCII Studio Pro subscriptions

ASCII Studio Pro is an optional auto-renewing subscription that unlocks the Pro effects catalog. Every ASCII style, animation, photo edit and export remains free without a subscription.

Plans: ASCII Studio Pro Monthly (1 month) and ASCII Studio Pro Yearly (1 year). Prices are shown in the app before you buy, in your local currency, and may vary by country.
Payment: charged to your Apple ID account when you confirm the purchase, or at the end of a free trial.
Automatic renewal: your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
Price changes: if the price of your subscription changes, Apple notifies you in advance and, where required, asks for your consent before you're charged the new price.
Restore: if you reinstall the app or use another device signed in with the same Apple ID, tap Restore on the Pro screen to unlock Pro again.
Family Sharing: not currently offered for ASCII Studio Pro.

Free trial

Where offered, the yearly plan starts with a 7-day free trial for people who haven't had a free trial of ASCII Studio Pro before (one trial per Apple ID, as decided by Apple). If you don't cancel at least 24 hours before the trial ends, the yearly subscription starts automatically and you're charged the yearly price. Any unused portion of a free trial is forfeited when you purchase a subscription.

Cancellation and refunds

Cancel anytime: on your iPhone or iPad, open Settings > [your name] > Subscriptions > ASCII Studio Pro > Cancel Subscription. You can also manage it at apps.apple.com/account/subscriptions. Deleting the app does not cancel your subscription.
After canceling: you keep Pro until the end of the period you've paid for. No partial refunds are given for the unused part of a period, except where required by law.
Refunds: payments are handled by Apple, so refunds are too. Request one at reportaproblem.apple.com.

Acceptable use

Don't use the app to break the law or infringe anyone's rights, and don't copy, modify, reverse engineer, resell or redistribute the app except as the law expressly allows.

Our rights

The app, its effects, styles, design and code belong to Morhover and its licensors. These Terms don't give you any rights to our trademarks or branding.

Apple terms

You and we acknowledge that:

These Terms are between you and Morhover only, not Apple. Morhover, not Apple, is solely responsible for the app and its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Morhover, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for investigating and defending any claim that the app infringes a third party's intellectual property rights.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Warranty and liability

We work hard to make the app reliable, but it's provided "as is" and "as available", without warranties of any kind beyond those required by law. To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, or for loss of data or content, arising from your use of the app. Our total liability is limited to the amount you paid for the app or subscription in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that can't be limited.

Governing law

These Terms are governed by the laws of India, and disputes are subject to the courts of Surat, Gujarat, except where the law of your place of residence gives you protections that can't be waived.

Changes

We may update these Terms. We'll change the effective date above and publish the new version here and in the app. If a change materially affects your rights, we'll make it clear in the app before it takes effect.
